Legal culture of a police officer as a response to the provocative actions of citizens

Abstract:
The article studies provocation as one of the forms of discriminational actions of citizens aimed at deliberate impairment of dignity and authority of a police officer. The authors reveal the reasons of provocative actions of citizens against police officers, the lack of experience of police officers in the prevention of provocative actions, the absence of regulations imposing legal responsibility of citizens for such actions in the Russian legislation. The authors analyze significant components of legal culture of a police officer which help to interact with citizens within legal boundaries. The authors use the methods of analysis and synthesis of the current scientific concepts considering the essence of legal culture and the ways of forming professional legal awareness of police officers; content-analysis used for studying mass media texts and helping to establish and problematize the research method and detect destructive strategies of interaction between citizens and police officers. The scientific novelty of the study consists in problematizing provocation as one of the forms of discreditation of a police officer by citizens, establishing the motive underlying this destructive behaviour, and the reasons hampering effective prevention of discreditation of police officers. The authors analyze the significance of forming legal culture of police officers for the prevention of provocative actions of citizens, give recommendations about the improvement of legal, moral and psychological training, professional training of police officers aimed at the formation of skills of prevention of provocative actions of citizens.

Abstract:
The research subject is the improvement of education process in educational institutions of the Ministry of Internal Affairs of Russia. The purpose of the research is to prove the necessity to use practicals involving the method of profiling for training law enforcement officers to perform their duties to protect public order and safety. The authors consider the variants of practicals with students and attendees of educational institutions of the Ministry of Internal Affairs aimed at the formation of professional expertise in the field of public order protection, and supervision over persons potentially dangerous for public safety in crowded places. The research is based on the method of theoretical consideration, analysis of literature sources and generalization of scientific and methodical materials, pedagogical observation. The research methodology is based on the theory of cognition and the practice of its integration into the system of professional education. The authors substantiate the necessity to train the students and attendees of educational institutions of the Ministry of Internal Affairs to use the method of profiling for their professional duties aimed at public order and safety protection during sports events and other public events. The scientific novelty of the study consists in the fact that the authors substantiate the necessity to study and use the method of profiling by law enforcement officers in their practice aimed at public order protection, and offer the variants of practicals aimed at demonstrating the method of profiling in order to form professional expertise of the students.

Abstract:
The research subject is the reasons and conditions of committing a crime specified in article 158.1 of the Criminal Code of Russia, scientific analysis of the problem and statistical data. The author of the article divides the reasons of crimes in question into general reasons and specific reasons. As general reasons, the author considers foreign-policy and internal impacts, corruption, legal nihilism and the weakening of particular value orientations. As specific reasons, the author considers those caused by faults in the work of particular services and companies, malpractice, failure to fulfil responsibilities and to protect the shopping facility. The research methodology is based on the following methods: analysis and comparison, logical interpretation, and the dialectical method. The scientific novelty of the study consists in the fact that the author attempts at analyzing the reasons and conditions of committing a crime specified in article 158.1 of the Criminal Code of Russia, and gives their classification. The author studies the current state of larceny. The author gives positive assessment to the position of the legislator in relation to the introduction of responsibility for petty larceny committed by a person under administrative penalty. The author explains the statement that reasons and conditions are not equal terms, but they are closely connected, and this connection manifests itself in their interaction.

Abstract:
The article analyzes the potential of such empirical methods of pedagogical research as questioning, the most widely used method, and the method of focus groups, which is relatively new. The author studies the example of verifying the results of questioning for the assessment of the development of aesthetic culture of law enforcement officers. The author explains the understanding of questioning as one of effective quantitative methods of pedagogical research, describes the experience of using questioning among 146 law enforcement officers in different regions aimed at studying the development of their aesthetic culture. Simultaneously, the author analyzes the potential of using the quantitative method of focus groups which gives the opportunity to get full and complex information during the discussion and direct contact of the interviewer with interviewees. The results of the questioning are compared with the results of focus groups. The article contains a description of the experience of using focus groups for studying the development of aesthetic culture of law enforcement officers; the author describes the process of preparation and organization of the focus-group study, its stages and their content. The author comes to the conclusion that the method of focused interview can be used in pedagogical research in order to increase its effectiveness and specify the qualitative aspects which can’t be studied via other empirical methods. This method helped to reveal such phenomena as “need-motivation” component and “active-creative” component, which were not mentioned during questioning in the interpretation of the notion of “aesthetic culture of law enforcement officers”.

Abstract:
The research subject is the formation and theoretical substantiation of general professional training of police officers employed for the first time, aimed at the development of the personality of the subject of professional activity. The author considers the key problems of the current system of professional training of police officers employed for the first time, and analyzes the results of police officers educating based on the example of a particular educational institution of the Ministry of Internal Affairs. The author suggests evaluating the effectiveness of general professional training by evaluating the officers’ compliance with the requirements of the profession. The author uses analysis of psychological and pedagogical literature on the issue of the study, pedagogical modeling, questioning, diagnostic testing of police officers at the educational institution of the Ministry of Internal Affairs of Russia, etc. The research methodology includes the system, system-pragmatist, personal-pragmatist and competency-based approaches. The scientific novelty of the study consists in the fact that well-thought general professional training of police officers employed for the first time helps form their ability to act reasonably and promptly in particular conditions of the operational situation. It helps form their professional self-identification and develop regardless of their educational background and positions.
