The author concludes, that the critics of the modern criminal procedural legislation of Russia is adequate. Comparatively, the author makes the foundation for detention, provided by the legislation of RF and FRG. Special attention is given to the detention at the place of crime and to the special features of the so-called “all-possible” detention.
