G.A. Esakov Negative Features of the Corpus Delicti

Abstract: comparatively, at the example of the German Criminal Code, the author critically analyzes the notion of the corpus delicti according to the criminal legislation of Russia. In the same aspects, the aroused questions are analyzes regarding the general law and the continental law. The author concludes, that it is necessary to create a normative legal construction, which can have a conditional name — «negative features of corpus delicti”. This construction should include the circumstances, excluding criminal responsible.
