Abstract: This article denotes aspects concerning the legal status of the utility software in Russia and in the UK. The analysis bases on the provisions of the Fourth Part of the Civil Code of the Russian Federation, the Copyright, Designs and Patents Act, 1988, as well as law enforcement. The recommendations on reducing the risk of a dispute between the employee (the developer of a computer program) and the employer are highlighted
