Abstract: В статье исследуется современное американское законодательство в части регулирования отношений с коренными жителями континента. Автор выделяет несколько основных принципов федерального законодательства в отношениях с индейцами. В заключение делается вывод о том, что современное регулирование
прав и основных свобод коренных народов в США происходит на федеральном уровне посредством конституции, федерального законодательства, заключенных ранее договоров, имевших место судебных прецедентов и
частично обычным правом. Все это находит свое выражение в таком понятии, как «федеральное индейское
право», которое является совокупностью юридически обязательных норм, регулирующих правовой статус индейских племен и их особые отношения с федеральным центром.
