Abstract: We proudly present to you the special edition of the “Law and Politics” journal based upon the materials of the Russian-French seminar which took place at the Southern Federal District of the Russian Federation in Rostov-on-Don on April 28, 2005 and was devoted to the topical problems of crisis management by the state bodies. As Ambassador of France in Russia Jean Cadet, who took part in this seminar, has noted, among the challenges faced by the government bodies of all the states, the following issues are of great importance and urgency: What are the concepts of crisis prevention? What should be done to save the people in a crisis situation? How is the state to ensure the victims’ interests under the vigilant watch mass media? How to remain within the legal framework and protect the values of freedom and democracy, when the safety and security are at stake and every minute of inaction counts? During the seminar leading experts representing various government departments of Russia and France gave their answers to these and other related questions. In particular, the seminar concerned the role of government structures in crisis management, dealing with natural and man-made catastrophes, cooperation with mass media and international cooperation. The special issue of our journal also includes voluminous extracts from a number of French normative legal acts related to fighting terorrism. In particular, we present extracts from the Criminal Code of the Republic of France, the Criminal Procedural Code of the Republic of France, a number of Circulars of Minister of Justice of France (inofficial translation). We suppose that these extracts shall be of interest to our readers within the framework of the seminar materials.

Abstract: Joel Lebechou is a Prefect, and he works at the the Department of Modernization and Territorial Activities of the Ministry of Internal Affairs of France. He deals with state subdivisions in crisis situations, including natural catastrophes, and is quite experienced in this field. His speech is devoted to organization of crisis prevention in France. In particular he reviewes certain provisions of French legislation on internal security, correlation and differentiation of French justice and police, administrative and judicial police. He also pays much attention to competence and functions of Prefects in crisis management.

Abstract: Jean-Louis Nadal is the General Public Prosecutor at the highest judicial body of France - the Court of Cassation of France, and he headed the largest prosecution bodies in France. His speech is devoted to the need for coordination of efforts of law-enforcement bodies and judicial bodies in crisis management. He pays much attention to the combinations of actions of various state bodies (for example, prosecutors and prefects) in crisis situations, importance of their cooperation. He also provides a number of examples from his own experience.

Abstract: The speech of Boris Mylnikov is devoted to the topical issues of fighting terrorism at the post-Soviet territories and in the CIS states, creation of legal mechanisms, allowing to unite the powers and sources of different states to stop terrorist attacks. He introduced the Regulations on organization and realization of joint anti-terrorist operations at the territories of the CIS states, which was developed by his Center and affirmed by the Protocol by 10 CIS states (ratified by 9 states, except Georgia). Abstract: Jean-Louis Fiamanghi is the Head of the National Department of Special Operations (R.A.I.D.). Speach of the head of the French special forces is devoted to three issues: role of French special forces in fighting terrorism, management of units against hostage-taking and crisis management. Abstract: Boris Mylnikov's speech is devoted to the problems of combating terrorism in the post-Soviet space and in the CIS countries, in the Russian Federation, the creation of legal mechanisms that allow all the forces and means of states to unite in order to suppress terrorist acts. They presented the Regulations developed by the Center on the procedure for organizing and conducting joint anti-terrorist activities in the territories of the CIS member states, the protocol on approval of which was signed on October 7, 2002 by the heads of 10 Commonwealth states (ratified by 9 states except Georgia), testing the practical application of this Provision during the exercises in Chisinau in 2004, a number of proposals were made.

Abstract: In this part of his speech Joel Lebeschu presented a number of ideas on the state activities at the time of catastrophes based on his own personal experience as a Prefect of two Departments. Abstract: Claire Arnould is the Plenipotentiary Representative of the General Secretariat on the Issues of National Defense to the Prime-Minister of France. The Secretariat of the Prime-Minister works in cooperation with the services of the President of France and aids the Head of French Goverment in ensuring national defence and security. Her organization deals with strategical studies of methods of cooperation of various government bodies of France. In her speach she mentions key directions of her work, and talks of the “Vigipirate” terrorism fighting plan.

Abstract: The speech of Nikolay Shepel is also devoted to the terrorism fighting issues. He speaks of a number of examples of criminal cases against terrorists, which he considers to be successful. As Nikolay Shepel notes, the last year was characterized by a lower number of terrorist crimes, while the consequences of such crimes were generally more grave. The lower number of this type of crimes in the District (from 416 to 225) is due to the lower number of registered terrorist crimes in the Chechen Republic (minus 165 crimes, fall from 386 to 221).

Abstract: Nikolai Shepel's speech is also devoted to the problems of combating terrorism. It examines a number of examples of criminal cases, which he characterizes as a successful experience in the disclosure and investigation of this category of crimes. As N. Shepel notes, the past year was characterized by a steady downward trend in the total number of terrorist crimes against the background of an increase in the severity of their consequences. At the same time, the overall decrease in these crimes in the district from 416 to 255 occurred almost entirely due to a decrease in registered terrorism crimes in the Chechen Republic (by 165 crimes or from 386 to 221).

Abstract: At this part of seminar Joel Lebeschu speaks of communications between the government officials and the mass media in a democratic state. As he points out, if there is a crisis situation, the government should be a trustworthy source of information for the media, while addressing the mass media in an official language. If the mass media get an impression that the government does not have the information needed, they shall search for sources of information elsewhere and they shall find such sources, for example, among the general population.

Abstract: T.N. Seledtsova’s speech is devoted to the role of mass media in informing the general public of crises, including those related to terrorism. As she points out, often the problem of terrorism is presented by the media in a way that does not necessarily form a negative attitude to it… She also speaks of an existing practice of “non-repressive” relations between the government bodies and the mass media.

Abstract: Earlier, Jean-Louis Nadal spoke about the role of the judiciary and administrative power in crisis management. This part of his speech is devoted to the method of crisis management and the media in such cases when the crisis has judicial consequences - regardless of whether it is a hostage-taking, a terrorist act, or a catastrophe or a collective accident, which may be based on the human factor - from two different positions, namely, On the one hand, as is customary in France, that is, when information is provided by various authorities, and on the other hand, when certain restrictions on freedom of the press are imposed in such crisis situations, he gives specific examples of cases of such restrictions in French criminal law and procedure.
